Terms of use for the RHS Award of Garden Merit

These terms of use apply to the RHS Award of Garden Merit (the “Award” or the “AGM”).

1. Award User
The Award User is the person or entity that has been allowed to use the Award for a particular plant as set out in these terms of use. An Award User may be a supplier, breeder, grower, or retailer of a plant that has been awarded the Award.
2. Media Writer
In these terms a media writer writing about a plant that has been awarded the Award is referred to as a ‘Media Writer’.
3. The Digital Asset
Where a digital asset of the Award is available, the RHS will provide it to the Award User and Media Writer. An Award User and Media Writer must not create their own physical, photographic or digital image of the Award, or anything confusingly similar, or alter any digital asset provided by the RHS.
4. The Award Statement
If an Award User wishes to refer to the Award in writing they must use the following Award Statement:

This plant has been awarded the RHS Award of Garden Merit because it has proved to be excellent for ordinary use in appropriate conditions and a good performing plant. For more information on RHS Award of Garden Merit plants, please visit the RHS Plant Trials and Awards page.
5. Use of the Digital Asset and/or Award Statement
The Award User may use the Digital Asset and/or Award Statement in its own printed and digital marketing materials related to its business, in retail displays relating to its business, and on product labels or packaging.  Examples of prohibited uses include use of the Digital Asset or Award Statement on vehicles, products, uniforms or signage (other than signage within a retail display). The Digital Asset or Award Statement may only be used in relation to the plant that was awarded the Award, and not used with any other plant or product.
6. Use of the Digital Asset by a Media Writer
A Media Writer may use the Digital Asset to write about a plant that has been awarded the Award. The Digital Asset may only be used in relation to the plant that was awarded the Award, and not used with any other plant or product.
7. All other uses are prohibited
Unless the RHS has given its prior written consent, all other uses of a Digital Asset or the Award Statement are strictly prohibited.  An Award User and Media Writer must not permit, allow or enable any third parties to use a Digital Asset or the Award Statement, as applicable, or anything confusingly similar to them.
8. Duration
The Award is subject to regular review by the RHS Expert Groups, to make sure that each plant still merits its place on the AGM list. An Award User may use the Digital Asset and Award Statement until such time as the RHS notifies the Award User that the particular plant has been removed from the AGM list. After such time, the Award User must immediately cease their use of the Digital Asset and Award Statement, as applicable, in relation to that particular plant.
9. RHS Trade Marks
Use of the RHS’ names, logos or trademarks other than as set out in these terms of use is strictly prohibited.
10. Conduct
An Award User must not do anything that, in RHS’s reasonable opinion: (a) does not align with the RHS’s current aims, strategy or policies; or (b) may bring the RHS or the Award into disrepute, or damage their reputation or goodwill.
11. Termination of Use
On written notice, the RHS may terminate the rights of an Award User or Media Writer early under these terms of use if the RHS reasonably considers that they have not complied with these terms of use, and on receipt of the notice they must immediately cease their use of the Digital Asset and Award Statement, as applicable.
12. Amendment
The RHS may amend these terms of use from time to time. The RHS will make the current terms of use available on this page on the RHS website. Please check to ensure you comply with the current terms of use.
